So you just got home from a lovely vacation in the Bahamas where you were wowed by the best vacation of your life and suckered into buying a timeshare you really couldn’t afford believing that you were getting deal. Now that the ambiance of relaxation is no longer clouding your judgment, reality is starting to sink in: Oh crap! What have I done?
Fear not, my friend. If your purchase is recent, it might not be too late to get out of your timeshare contract before it’s too late. If you bought a timeshare in the US, you typically have 5 to 15 days to rescind (a fancy word for cancel) your contract though the rescission period does vary from state to state and can be as short as 3 days. If you bought your timeshare in Mexico, the rescission period is 5 days. In the United Kingdom, it’s generally 14 days while it’s only 10 days anywhere else in Europe.
The most important part of the rescission process is to act fast since you don’t have a lot of time, not to mention the fact that you probably want to account for any possible delays like unreturned phone calls or simply getting the run around and filling out any necessary paperwork. The first thing you want to do, however, is to read your contract thoroughly to find the specific terms of rescinding your contract. Somewhere on that gobbledygook document, in tiny little print, you will find your rights to rescind, the procedure to make it happen and the number of days you have to take action.
To ensure that your rescission goes smoothly and successful, make sure you follow the procedures exactly as they are presented in your contract. Write a letter to the developer letting them know that you are exercising your right to rescind your contract, and include your name, your address, your contract number and your date of purchase. If they have their own rescission form, it might simplify the process or make it go by faster if you use their form instead.
